SECTION I: PRIVACY AND DATA PROTECTION POLICY

1. GENERAL COMMITMENT AND LEGAL FRAMEWORK

    At INTI ADVENTURE TRAVEL E.I.R.L. (hereinafter “The Agency”), we value your trust and guarantee the protection of your personal information. This Privacy Policy establishes the guidelines under which we collect, use, store, and protect our clients’ personal data, in strict compliance with the Peruvian Personal Data Protection Law (Law N° 29733), its Regulations (Supreme Decree N° 003-2013-JUS), and complementary MINCETUR regulations.

    2. INFORMATION WE COLLECT

    To provide our tourist services as an Operating Agency, we collect the following data:

    • Identification data: Full name, passport or ID number, nationality, date of birth, and gender.
    • Contact information: Email address, phone number (WhatsApp), physical address, and country of residence.
    • Health and safety data: Dietary restrictions, allergies, pre-existing medical conditions, and emergency contacts (vital and mandatory information for adventure tours and treks).
    • Financial data: Payment and billing information (processed securely and encrypted through our authorized payment gateways).
    3. PURPOSE OF DATA PROCESSING

    Personal data will be stored in our “Clients” database and used exclusively to:

    • Process reservations for tour packages, hotels, train tickets, and transportation.
    • Purchase entrance tickets for the Inca Trail, Machu Picchu, and other attractions from the Ministry of Culture (MINCUL) and SERNANP.
    • Issue electronic payment receipts (invoices or receipts) in compliance with SUNAT.
    • Ensure the safety and well-being of the passenger during the provision of the tourist service.
    • Commercial and marketing purposes (sending newsletters or promotions), subject to the client’s prior and express consent.
    4. DATA SHARING WITH THIRD PARTIES

    The Agency guarantees data confidentiality. However, due to the nature of the tourism service, the client authorizes the transfer of strictly necessary information to verified third-party suppliers (PeruRail, IncaRail, hotels, Ministry of Culture, insurance companies) solely for the purpose of executing the travel contract. Under no circumstances will your information be sold or traded.

    5. SECURITY MEASURES AND RETENTION PERIOD

    We implement technical, organizational, and legal security measures to prevent unauthorized access, alteration, or loss of your data. The data will be kept for the time necessary to fulfill the purpose for which it was collected and according to the Peruvian legal limitation periods.

    6. EXERCISE OF ARCO RIGHTS

    The user, as the data owner, may at any time exercise their rights of Access, Rectification, Cancellation, and Opposition (ARCO Rights). To do so, you must send a formal request attaching a copy of your ID or passport to the email: info@intiadventuretravel.com. The Agency will respond within the timeframes established by Peruvian law.

    7. COMPLAINTS BOOK

    SECTION II: TERMS AND CONDITIONS OF USE AND BOOKING POLICIES

    1. ACCEPTANCE OF TERMS AND APPLICABLE REGULATIONS

    By booking the services of INTI ADVENTURE TRAVEL E.I.R.L., the passenger declares to know and accept these Terms and Conditions, which are governed by the Regulations for Travel and Tourism Agencies (D.S. N° 005-2020-MINCETUR) and the laws of the Republic of Peru.

    2. BOOKING AND PAYMENT POLICIES
    • Deposit: Every reservation requires an initial payment of 50% of the total value of the tour package to be confirmed.
    • Final Payment: The remaining 50% balance must be paid a maximum of 48 hours before the start of the service or at the time of the briefing upon your arrival in the city of Cusco.
    • Payment Methods: We accept interbank transfers, credit/debit cards, and cash. Bank fees or commissions generated by international transfers are fully assumed by the client.
    3. CANCELLATION POLICIES

    All cancellation requests must be sent in writing to info@intiadventuretravel.com . Penalties apply based on the advance notice given:

    • More than 30 days before the tour: 20% retention of the payment for administrative and logistical expenses.
    • Between 29 and 15 days before the tour: 50% penalty of the total service value.
    • Less than 14 days (or “No Show”): 100% penalty. No refunds apply.
    ⚠️ STRICT EXCEPTION AND GOVERNMENT REGULATIONS: Inca Trail permits, entrance tickets to Machu Picchu, and train tickets (PeruRail/IncaRail) are STRICTLY NON-REFUNDABLE, NON-TRANSFERABLE, AND NON-RESCHEDULABLE under any circumstances, due to current government and institutional regulations.
    4. REFUND POLICIES

    If a refund is applicable under our policies, it will be processed through the original payment method within 15 to 30 business days. Bank commissions derived from the refund transaction will be deducted from the final amount.

    5. HEALTH, PHYSICAL CONDITION, AND ASSUMPTION OF RISK

    The client acknowledges that adventure tours (Inca Trail, Salkantay, Ausangate, etc.) involve inherent risks and physical effort at high altitudes. It is the passenger’s sole responsibility to report any medical condition. The Agency reserves the right to refuse the participation of a passenger if their health endangers their integrity or that of the group. It is mandatory for the passenger to have comprehensive travel insurance covering medical expenses and evacuation.

    6. RESPONSIBILITY AND FORCE MAJEURE

    INTI ADVENTURE TRAVEL E.I.R.L. acts solely as an intermediary agent for certain services. We are not responsible for itinerary alterations, cancellations, delays, or extra expenses resulting from Force Majeure events (natural disasters, bad weather, strikes, roadblocks, civil unrest, or government decrees). In such cases, The Agency will provide support for viable rescheduling, subject to the availability and policies of third-party suppliers.

    7. JURISDICTION AND APPLICABLE LAW

    For any dispute that may arise from the interpretation or execution of these terms, both parties expressly submit to the jurisdiction of the Judges and Courts of the city of Cusco, Peru, waiving any other jurisdiction that may apply to them.

    SECTION III: PREVENTION OF SEXUAL EXPLOITATION OF CHILDREN AND ADOLESCENTS (ESNNA)

    INTI ADVENTURE TRAVEL E.I.R.L. is a socially responsible travel agency. In strict compliance with Law N° 29408 (General Tourism Law) and Law N° 30802 of Peru, we actively adhere to the Code of Conduct against the Sexual Exploitation of Children and Adolescents (ESNNA).

    We emphatically reject and condemn any type of exploitation, pornography, or abuse of minors within the tourism sector. The protection of minors is a priority for us. Therefore, we warn that any suspicious or illegal conduct by clients, suppliers, or staff will be immediately and irrevocably reported to the Peruvian National Police (PNP) and the competent authorities.
