General Terms and Conditions of Service
This document constitutes the binding corporate contract for travel and tourism services governing the commercial relationship between Inti Adventure Travel E.I.R.L. (hereinafter, “The Agency”) and the user or purchaser of the services (hereinafter, “The Client”). By rendering any payment, processing a reservation deposit, or confirming an itinerary, The Client formally declares to have read, understood, and unconditionally accepted the totality of the clauses set forth herein.
- Personal Documentation, Visas, and Legal Entry Requirements
It is the exclusive, absolute, and mandatory responsibility of The Client to comply with all immigration, customs, and health regulations enforced by the government authorities of the Republic of Peru.
Passport Validity: The Client must possess an official, valid passport with an expiration date of no less than six (6) months beyond the scheduled date of entry into Peruvian territory.
Visas and Permits: Securing consular visas, travel authorizations, or specialized immigration forms required based on The Client’s nationality is strictly their personal responsibility.
Absolute Liability Disclaimer: The Agency shall assume no financial liability, refund obligation, or collateral costs if the Peruvian Immigration Authorities (Migraciones) or international airline carriers deny entry, block boarding, or deport The Client due to lack of documentation, legal impediments, or invalid passports. All expenses arising from such events shall be borne solely by The Client.
- Health, Physical Fitness, and Medical Assumption of Risk (Altitude / Soroche)
The premium itineraries curated by The Agency across regions such as Cusco, the Sacred Valley, and Machu Picchu take place at high altitudes ranging between 2,400 and over 3,400 meters (7,800 to 11,100+ feet) above sea level, which demands varying degrees of physical effort and physiological adaptation.
Health Declaration: The Client solemnly declares that they are in optimal physical and mental health to complete the contracted itinerary, having consulted a qualified medical physician prior to departure.
Altitude Sickness (Soroche): The Client acknowledges that altitude sickness is a natural, unpredictable physiological condition. While The Agency will provide basic guidance and orientation assistance, The Agency is not liable for medical decompensation, clinical emergencies, or The Client’s inability to execute the tour due to altitude complications or pre-existing medical conditions.
Voluntary Tour Abandonment: If The Client chooses to suspend, shorten, or withdraw from the itinerary in whole or in part due to health anomalies or altitude symptoms, such action will be deemed a voluntarily unused service. Consequently, The Client forfeits any right to refunds, c
ompensation, or structural credit, in strict accordance with our Cancellation and Refund Policy.
- Luggage Custody and Liability Exclusion for High-Value Items
While The Agency orchestrates elite logistics featuring VIP transport units, carefully vetted luxury accommodations, and expert guides, the surveillance of personal property remains an exclusive, non-transferable duty of The Client.
High-Value Property Disclaimer: The Agency accepts no liability for the loss, theft, burglary, damage, or misplacement of personal belongings left inside private transport vehicles, trains, restaurants, or within archaeological parks during excursions. This exclusion encompasses, without limitation: physical cash, jewelry, high-end watches, laptops, tablets, professional photographic equipment, specialized lenses, or passports.
Mandatory Safes Utilization: The Client is strictly required to secure all financial assets, documentation, and high-value equipment inside the digital safety deposit boxes provided within their luxury hotel rooms. The Agency is fully exonerated from any civil or tort liability arising from security incidents taking place inside third-party hospitality establishments.
- Passenger Code of Conduct and Right of Refusal
To safeguard the security of our corporate operations, preserve the elite standard of the travel experience, and protect the well-being of our operational staff and partners, The Agency strictly reserves the right of refusal and retention of service.
Disruptive Behavior: If The Client engages in aggressive, discriminatory, verbally abusive conduct, or is under the evident influence of alcohol, controlled substances, or narcotics, or otherwise compromises the safety of the guides, drivers, or third parties, The Agency may terminate the service contract immediately
On-Site Expulsion: Upon contract termination due to behavioral misconduct, The Agency is legally empowered to remove The Client from ongoing transport units or archaeological sites. The Client shall have no right to file a claim, nor receive any refund, compensation, or rescheduling options, and must assume all logistical arrangements and costs for their independent return transit.
- Payment Structure and Settlement of Outstanding Balances
Booking Deposit (Prepayment): To initiate the bespoke curation of the itinerary and clear the immediate booking of non-refundable third-party services, The Client must settle an initial prepayment via the authorized PayPal platform.
Mandatory Balance Settlement: The total outstanding balance of the contracted travel portfolio must be settled in full by The Client on the first day of arrival in the city of Cusco, prior to the formal execution of any operational excursion.
Cash Payments: Should The Client choose to settle the balance in cash, payments will be accepted in US Dollars (USD) or Peruvian Soles (PEN). Banknotes must be in pristine condition, entirely free of tears, markings, stamps, or heavy wear. Damaged currency will not be accepted under any circumstance due to local banking sector regulations.
Credit or Debit Card Payments: If The Client prefers to settle the remaining balance via credit or debit card upon arrival, they explicitly agree to an automatic, mandatory payment gateway processing surcharge (typically ranging between 4% and 5% additional over the balance amount), which is fundamentally excluded from the initial trip quotation.
- Operational Itinerary Modifications by the Agency
Given the complex geographical dynamics of Peru and the intricate synchronization required for bespoke luxury services, The Agency reserves the right to execute operational adjustments regarding the chronological order of visits or specific tour components. Such modifications may be triggered by force majeure, unannounced state closures of historical landmarks, railway technical maintenance, or external logistical delays. These adjustments will always be managed to safeguard the premium tier of the contracted experience, notifying The Client promptly, and shall under no circumstance constitute a breach of contract.
- Governing Law and Territorial Jurisdiction
This contractual agreement shall be strictly governed by, construed, and enforced in accordance with the statutory laws of the Republic of Peru. For the resolution of any legal disputes, breach of contract allegations, or administrative consumer protection claims filed before INDECOPI, the parties explicitly waive the jurisdiction of their home countries and formally submit solely and exclusively to the territorial competence of the judges and courts of the city of Cusco, Peru.
- Commitment to the Prevention of the Commercial Sexual Exploitation of Children and Adolescents (ESNNA)
Zero Tolerance Policy: The Agency declares its absolute rejection and zero-tolerance policy toward any form of sexual, labor, or commercial exploitation of children and adolescents, in strict compliance with Peruvian Law No. 29408 (General Tourism Law), the ESNNA Code of Conduct, and current criminal statutes of the Republic of Peru.
Mandatory Identification: Should The Client travel accompanied by minors, it is a mandatory requirement to present the minors’ official identification documents (ID or Passport) and legally verify parental authority or guardianship through birth certificates or notarized travel permits, as applicable.
Active Reporting: The Agency’s operational staff, guides, and transport personnel are fully empowered and legally obligated to immediately report to the competent authorities (the National Police of Peru and the Public Prosecutor’s Office) any suspicious behavior, risk scenario, or attempted violation of a minor’s rights during the execution of any travel services.
